ALLEN TATE / BEVERLY-HANKS, REALTORS® Listing Agent Duties and Responsibilities – Agent and Agency Duties
A real estate listing agent is the seller’s representative in a real estate transaction. Some of my duties as a listing agent at ALLEN TATE / BEVERLY-HANKS, REALTORS® include:
- Placing your property on the market
- Exposing your property to the greatest number of potential buyers and their agents by:
- Placing a “for sale” sign on your property
- Advertising your property widely, including on the internet
- Placing your listing on an MLS
- Holding open houses, including broker’s open houses
- Placing signage on your property
- Using marketing vehicles as appropriate
- Using media commonly used to advertise properties for sale
- Finding buyers for you property
- Conducting open houses, if appropriate
- Providing a reasonable means for other brokers to show your property
- Being available to show your property in a timely manner
Informing you (seller/s) about your role in selling your property, such as:
- Increasing marketability:
- Enhance curb appeal, make repairs, declutter, paint, etc.
- Safeguarding personal valuables
- Making the property available for showings
- Leaving the property for showings
- Removing or securing pets for showings
- Managing unscheduled showings (they happen!)
- Responding to inquiries without damaging their own negotiation position
- Handling offers
- Assisting you through the transaction once a buyer is found
- Cooperating fully with other agents as you authorize
- Protecting your interests throughout the process
- Being loyal to you and your property, and looking out for your interests
- Working with other brokers, customers and the general public with honesty and integrity
- Disclose known facts about the property that may be material to the transaction
- Maintaining client confidentiality and not disclosing confidential information about you to a prospective buyer (unless it’s a material fact)
- Presenting all offers to you as soon as is practical
- Conducting business in a manner that is above board, truthful, and honest
- Using reasonable skill and care when working with all people involved in a real estate transaction, whether they’re my clients or not
- Complying with the laws, regulations, statutes, and obligations established by federal, state, and local governments, and abiding by the duties and responsibilities outlined therein
Additional Duties
When WNC Real estate Broker at ALLEN TATE / BEVERLY-HANKS, REALTORS® Dwain Ammons represents a seller, they sign a listing agreement. Listing agreements are legally binding contracts entered into by me, my firm and the seller (although legally the listing is with and belongs to your broker). My responsibilities through the listing agreement are that I must:
- I shall Carry out the terms of the brokerage agreement with skill and care.
- Remain loyal to you and promote your interests through the entire transaction.
- Sell the property at the price and terms stated in the agreement, or at a price that’s acceptable to you.
- Advise you to obtain advice from qualified professionals and experts when the needed information is beyond your expertise.
Elements of Western North Carolina Real Estate Listing Contracts
According to North Carolina General Statutes, all listing agreements must:
- Have a definite expiration date. Stating a time period, such as six months, is inappropriate. The agreement shouldn’t automatically renew, and it will terminate without prior notice.
- Contain anti-discriminatory language.
- Be signed by all parties to the agreement.
- Include the listing broker’s license number.

- There’s no requirement that a written listing agreement be contained on a specific form. However, to be legally binding, it must be written in clear and unambiguous language, and it must be signed by all parties to the agreement (i.e., the sellers and the listing agent).Often, brokers will use preprinted forms from the North Carolina Association of REALTORS® (NC REALTORS®), though some firms have their own agreements written by licensed attorneys.
- Whatever you choose to use, make sure that your listing agreements contain:
- Specific beginning and ending dates for the agreement
- Compensation terms and conditions
- How commissions will be paid to your firm and to any other cooperating agents
- The property’s list price, as well as other relevant information (including its location)Information regarding whether seller will provide permission to install lockboxes, post the listing on the MLS, and/or reveal the existence of other offers to potential buyers
- The parties don’t have the right to terminate the agreement early unless specifically noted in the written agreement. If the property goes under contract during the term of the listing agreement, the broker is entitled to the commission even if closing will take place after the end of the listing period. A broker who continues to represent a seller actively after the listing agreement expires and prior to a seller accepting an offer will not be eligible for compensation. Any agreement to amend or extend the listing period must be in writing to be enforceable.
